This isn’t new. Men have had their non-donated sperm taken from banks without their permission and courts have told them they have to pay child support.
I think an important note on this is that it was not an official donation – this was a Craig’s list ad and turkey baster type of scenario.
And it’s not the mother suing, it’s the state because the mother is seeking welfare support. She doesn’t appear to be party at all.
Still it’s nuts, and poor precedent.
I think there is something to a lower court interpretation here that does make sense. Basically, if I understand the arguement; a Dr. provides the assurance that this is a donation – without the Dr. the donor or recipient can’t prove it was a donation, it’s as if it was a one night stand. Which I can see the logic in that – we don’t want people using donation as an excuse to evade child support.
So it’s at least a bit more complex than the title puts on (even if it is a bit crazy)
