There’s something comically stupid about companies or creators trying to trademark a word or phrase that has existed in the English language long before them.
INAL: A beverage company with the name “Monster” does not have its trademark violated by the video game with the same name that makes no mention of an energy drink. Although this will undoubtedly be rejected, this was a cheap scare tactic that will still cost the developer time and money. Absolutely, Monster Energy needs to pay for this pointless lawsuit.
This is a real problem with Monster Energy; they sued MurLarkey distillery for trademark infringement for using a letter ‘M’ logo, even though it looks nothing at all like the Monster logo and the product is not only liquor without caffeine but also only available through a handful of ABC stores in Virginia. Monster is a small dog in a smaller yard barking at the kids across the street.

I sense a monstrous misuse of language. Idea: Rename the brew as Mons Veneris, with an illustrated label. See who tries to sue then.
