I believe that many people are overlooking the main points of the disclosure. Fox is confessing to lying to the judge and the prosecution on the eve of the trial. The omission was bizarre, as the judge correctly noted.
Why would it matter what the owner’s role is to whether the actions of the network were defamatory? The network’s culpability is beyond a shadow of a doubt, we have the text messages to see it. Murdoch could have been working the newspaper stand opposite the Fox building, and the conclusion should be the same.
